LAF Projects Pty Ltd (ACN 692 754 288) trading as Fornieri & Azar is a real estate agency based in Malvern East, Victoria. We provide commercial and residential sales, property management, and leasing services. We operate under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), as well as Victorian state regulations.

2. Types of Personal Information Collected

We only collect information that is reasonably necessary for our specific functions. We distinguish between routine enquiry data and sensitive transaction data:

  • Routine Interaction Data: Name, email address, phone number, and residential address (collected for security at inspections and general enquiries).
  • Transaction & Identity Data: Date of Birth (DOB), government-issued identification (e.g., Driver’s Licence), and financial history. Note: This is only collected when you submit a formal tenancy application, make a purchase offer, or enter a service agreement.
  • Property Preferences: Details of your interests, behaviour, and history of interactions with our listings.
  • Digital Data: IP addresses, device identifiers, and website navigation data via cookies.

3. How Information is Collected

We primarily collect information directly from you in-person, via our website, or through digital portals (e.g., Realestate.com.au).

  • In-Person (2026 Compliance): When you attend an "Open for Inspection," we collect your name and contact details for security. We may verify your identity against a photo ID, but we do not record sensitive ID numbers unless you proceed with a formal application.
  • Third Parties: We may receive data from credit reporting agencies or other real estate portals.

4. Use of Your Information

We use your information to:

  • Maintain Security: Ensuring the safety of properties, occupants, and staff during inspections.
  • Reporting: Informing vendors of interest levels in their property.
  • Marketing: Informing you of properties or services that match your preferences. You may opt-out at any time.
  • Automated Assistance: We use CRM software to help categorise enquiries. While these tools assist in prioritising communications, all final decisions regarding your applications or transactions involve human oversight.

5. Data Retention & Destruction

In accordance with the 2026 "Data Minimisation" standards:

  • Transaction Records: Records relating to completed sales or leases are retained for 7 years to comply with tax and professional indemnity requirements.
  • Sales Inspection Data: Information collected at sales inspections is retained to assist with your ongoing property search and strictly for marketing purposes until you opt-out. You may unsubscribe at any time.
  • Rental Applications & Inspection Logs: In compliance with Victorian Residential Tenancy regulations, personal information collected from unsuccessful rental applicants or solely for rental open-for-inspection security is deleted or de-identified within 6 months, unless you have specifically requested to remain on our rental database.
  • Unsolicited Information: Any personal information received that we did not request and do not need will be destroyed immediately.

6. Disclosure & Overseas Transfer

We do not sell your personal information. We disclose it only to:

  • Vendors and Landlords (only as necessary for the transaction).
  • Authorities (such as Victoria Police or insurers) in the event of an incident.
  • Service Providers: We use digital tools where data may be stored in the United States, Singapore, or Ireland. We ensure these providers maintain security standards equivalent to the APPs.

7. Security & Protection

We take reasonable steps to protect your data from misuse, loss, or unauthorised access. This includes:

  • Encrypted cloud storage and password-protected databases.
  • Strict "Condition of Entry" protocols at open homes.
  • Regular staff training on Victorian privacy compliance.

8. Access, Correction, and Deletion

You have the right to request access to your data, correction of errors, or the deletion (erasure) of your information where it is no longer required for a legal purpose.
